Σε συνέχεια της επιστολής διαμαρτυρίας που απέστειλε ο Σύλλογος Αποφοίτων στον ΟΤΕ για την προκήρυξη θέσης Μηχανικού Τηλεπικοινωνιών για IP δίκτυα, λάβαμε γνώση της παρακάτω επιστολής που απέστειλε η Διεύθυνση Οργανωτικής Ανάπτυξης της Γενικής Γραμματείας Δημόσιας Διοίκησης του Υπουργείου Εσωτερικών. Σχετ.: η από 18-1-2010 επιστολή του Συλλόγου Αποφοίτων Τμήματος Πληροφορικής & Τηλεπικοινωνιών Εθνικού & Καποδιστριακού Πανεπιστημίου ΑθηνώνΔεδομένου ότι η υπηρεσία μας, σύμφωνα με πάγια θέση της, η οποία αναφέρεται σε σειρά εγκυκλίων της, σε καμία περίπτωση, δεν υποκαθιστά τις αρμόδιες εποπτεύουσες υπηρεσίες, σας διαβιβάζουμε το ανωτέρω σχετικό έγγραφο του εν λόγω Συλλόγου, με τα συνημμένα αυτού, αναφορικά με το αντικείμενο του θέματος, για τις δικές σας απόψεις και τυχόν ενέργειες, λόγω αρμοδιότητας.
Συναφώς σας γνωρίζουμε, κατά λόγο αρμοδιότητας και προς δική σας διευκόλυνση, τα ακόλουθα:
Με τις διατάξεις του άρθρου 1 του Ν. 3812/2009 αντικαταστάθηκαν οι παρ. 1 και 2 του άρθρου 14 του Ν. 2190/1994, όπως ίσχυαν, και επανακαθορίστηκαν οι φορείς του δημόσιου και ευρύτερου δημόσιου τομέα, με την υπαγωγή και των δημοσίων επιχειρήσεων, οργανισμών και ανωνύμων εταιρειών του άρθρου 1 του Ν. 3429/2005, στις ρυθμίσεις του Ν. 2190/1994, αναφορικά με την πρόσληψη του προσωπικού τους.
Δεδομένου ότι στο πεδίο εφαρμογής του «Προσοντολογίου» (άρθρο 1 του Π.Δ/τος 50/2001, όπως ισχύει), υπάγονται, μεταξύ άλλων, οι φορείς του άρθρου 14 του Ν. 2190/1994, όπως ισχύει κάθε φορά, συνάγεται ότι στις ρυθμίσεις αυτού υπάγονται και οι φορείς του άρθρου 1 του Ν. 3429/2005 και στην προκειμένη περίπτωση, και η προκηρυχθείσα θέση Μηχανικού Τηλεπικοινωνιών (ΑΕΙ) για ΙP Δίκτυα στον Ο.Τ.Ε.
Ενόψει των ανωτέρω, σημειώνουμε τα ακόλουθα:
Σύμφωνα με τις διατάξεις του άρθρου 6 του «Προσοντολογίου», στις οποίες καθορίζονται τα προσόντα διορισμού για την πλήρωση θέσεων του κλάδου ΠΕ Πληροφορικής, παρατίθενται αναλυτικά τα πτυχία ή διπλώματα, που χορηγούνται από ΑΕΙ της χώρας μας και που το αντικείμενο σπουδών τους σχετίζεται με διάφορα πεδία, τομείς και εφαρμογές της Πληροφορικής.
Επιπλέον, στις ως άνω διατάξεις προβλέπεται η δυνατότητα των ενδιαφερόμενων φορέων να ορίζουν με την προκήρυξη πλήρωσης θέσεων εξειδικεύσεις της ειδικότητας Πληροφορικής, οπότε, ως προσόν διορισμού απαιτείται το ομώνυμο ή ταυτόσημο, κατά περιεχόμενο εξειδίκευσης, πτυχίο ΑΕΙ της ημεδαπής ή ισότιμο, αντίστοιχης ειδικότητας, της αλλοδαπής. Με την εν λόγω ρύθμιση, παρέχεται στους φορείς η δυνατότητα να επιλέξουν, με γνώμονα το αντικείμενο των μονάδων που θα στελεχωθούν, εκείνες τις κατευθύνσεις που θεωρούν ως τις πλέον κατάλληλες, σύμφωνα με τις ειδικότερες υπηρεσιακές τους ανάγκες.
Από τα παραπάνω προκύπτει ότι, εφόσον η συγκεκριμένη θέση προκηρύχθηκε από τον φορέα ως θέση Μηχανικού Τηλεπικοινωνιών, δικαίωμα συμμετοχής στην εν λόγω Προκήρυξη του ΟΤΕ έχουν όλοι οι κάτοχοι τίτλου σπουδών μηχανικού, μιας εκ των ειδικοτήτων που ορίζονται ρητώς στην σχετική προκήρυξη ως τυπικό προσόν διορισμού, ενώ επιπλέον μπορεί να γίνει αποδεκτό και κάθε άλλο αντίστοιχο κατά περιεχόμενο ειδικότητας πτυχίο μηχανικού, εφόσον αποδεικνύει την αντιστοιχία αυτή (άρθ. 26 παρ. 2 του Π.Δ. 50/2001, όπως ισχύει).
Όσον αφορά στην απαιτούμενη, σύμφωνα με την προκήρυξη, άδεια άσκησης επαγγέλματος, σημειώνουμε ότι στις διατάξεις του άρθρου 26 παρ. 8 του Προσοντολογίου ορίζεται ότι απαγορεύεται η πρόσληψη χωρίς την άδεια άσκησης του αντίστοιχου επαγγέλματος, για όσες ειδικότητες απαιτείται κατά τις κείμενες διατάξεις η άδεια αυτή, όπως συμβαίνει για όλες τις ειδικότητες των μηχανικών.
